Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Fitzpot platform. By accessing or using Fitzpot, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the platform.

1. Definitions

"Platform" means the Fitzpot software-as-a-service fitness management platform. "Customer" means any gym, studio, or fitness business that subscribes to the Platform. "End User" means members of a Customer's fitness business. "Data" means all information entered into or generated by the Platform.

2. Subscription and Access

Fitzpot grants Customers a non-exclusive, non-transferable licence to access and use the Platform during the subscription period. All features are available immediately upon subscription commencement. Fitzpot may update, modify, or add features at any time with reasonable notice.

3. Payment Terms

Subscriptions are billed monthly or annually in advance. All fees are non-refundable except as stated in our refund policy. Fitzpot reserves the right to suspend access to accounts that remain unpaid for more than 14 days after a due date.

4. Acceptable Use

You agree not to: use the Platform for unlawful purposes, attempt to gain unauthorised access to any part of the Platform, interfere with the Platform's normal operation, use the Platform to send unsolicited communications in violation of applicable law, or resell access to the Platform without authorisation.

5. Data Ownership

You own all data you enter into the Platform, including member data. Fitzpot has no right to sell, transfer, or use your data for purposes other than providing the service. You grant Fitzpot a limited licence to process your data solely to operate the Platform on your behalf.

6. Confidentiality

Both parties agree to maintain the confidentiality of the other's proprietary information. Fitzpot will not disclose Customer data to third parties except as required by law or to provide the service.

7. Service Availability

Fitzpot targets 99.9% uptime, measured monthly, excluding scheduled maintenance. Scheduled maintenance is communicated 48 hours in advance via email. Fitzpot's liability for downtime is limited to a service credit equal to the proportional subscription fee for the affected period.

8. Limitation of Liability

To the maximum extent permitted by law, Fitzpot's total liability to any Customer shall not exceed the fees paid by that Customer in the 3 months preceding the claim. Fitzpot is not liable for indirect, incidental, special, or consequential damages.

9. Termination

Either party may terminate the subscription at any time. Customers may export their data at any time during the subscription period. Upon termination, Fitzpot will retain data for 90 days before deletion, during which the Customer may request a data export.

10. Governing Law

These Terms are governed by the laws of India. Any disputes shall be resolved by the courts of Bangalore, Karnataka. For Enterprise customers, disputes shall first be attempted through mediation before litigation.
